Job Description
Key Responsibilities:
- Files legal suits for all accounts identified by or referred to legal from the Head of Credit Recovery, which includes gathering significant documents and information through a case management plan and setting up a case file to manage the entire process. This position holder is also responsible for managing other cases, including labor, contracts, and breach of mandate, as directed by the Head of Legal.
- Prepares drafts of pleadings and comprehensive instructions or briefs for external lawyers regarding litigation involving the Bank.
- Is involved in the strategic management of external lawyers' performance, which includes recommendations for their appointment, termination, distribution of instructions, and setting up performance review meetings.
- Ensures, with support from the Credit department, that legal risk in recovery is minimized by establishing performance-based contracts with debt collectors, private investigators, valuers, and other support functions to aid in recoveries.
- Ensures that demand notices and statutory notices are issued in a timely manner and after receiving advice from the Recovery department.
- Provides timely advice to business units and management on issues of law, compliance, corporate governance, and the legal framework governing the banking industry.
- Reviews securities, contracts, and all other banking and finance documents on a regular basis, particularly when a case is referred for legal recovery measures.
- Proactively identifies key legal risks and their mitigation to promote KCB Tanzania's business objectives and sustainability.
- Effectively manages fees and other costs associated with litigation.
- Attends Court, Tribunals, the Commission for Mediation and Arbitration, and Tax Tribunals on behalf of the Bank.
- Reviews securities, contracts, and all other banking and finance documents.
- Replies to demand notices and letters from various entities, including government institutions.
- Prepares various litigation reports for the Head of Legal, Credit, Group, External Lawyers, and the Board.
- Provides support to business areas and functions regarding their legal risks and issues, and provides services required to achieve their business and functional objectives.
- Attends Court, Tribunals, the Commission for Mediation and Arbitration, and Tax Tribunals on behalf of the Bank.
Minimum Position Qualification Requirements
Academic & Professional
- Education: Bachelor’s Degree in Laws (LLB) is required.
- Professional Qualifications: Advocate of the High Court is required.
- Added Advantage: Master’s degree in Laws, Business Administration, or Banking.
